What Merton's 2026 Article 4 Actually Covers

If you have heard that Merton recently brought in an Article 4 Direction across Wimbledon, that is true, and it is worth knowing what it does before assuming it affects you. The council made an immediate direction on 24 March 2026 covering thirteen wards, including Wimbledon Town, Dundonald, Village, Wimbledon Park, Hillside, Abbey and Merton Park.

It withdraws the right to convert a house into a small house in multiple occupation. It has nothing whatever to do with garden buildings, and no part of it touches the outbuilding right.

No Outbuilding Direction in Merton

The borough's only householder directions cover the John Innes conservation areas at Merton Park and Wilton Crescent, and every restriction in them is qualified to development fronting a public highway or other public space. A building in a rear garden sits outside their scope by construction.

Conservation Area Alone Is Not a Bar

Wimbledon sits across seven conservation areas including the Village, Wimbledon West and North, Hill Road, Broadway, Chase and the Windmill. Conservation area status restricts a building between a side elevation and the boundary and protects trees, but leaves rear garden buildings as permitted development.

What Does Close the Route

Two things. If your house is listed, nothing in the garden is permitted development, and Wimbledon has a scattering of listed ordinary houses on the Ridgway, Denmark Road, Lancaster Road and around the Green. And if your home is a flat or a converted house, Part 1 does not apply at all, so an application and freeholder consent are both required.

Whole-house share tracks it. Merton Park is around 74 per cent whole houses and the Village 60 per cent, against Hillside at 34 per cent. Merton's borough median garden of 119.5 square metres sits below the London figure, so the Common-side plots are doing a lot of work in that average.
