Private, Demised or Communal Garden

Maida Vale is defined by red-brick mansion blocks with large shared gardens behind them. Lauderdale Mansions opened in 1897, Elgin Mansions in 1900, Castellain Mansions in 1902, Delaware Mansions in 1907, and that stock still dominates the area. Local agents put the share of W9 homes that are flats at over ninety per cent, which is a marketing figure rather than a census one, but the direction is not in doubt.

That makes garden ownership the first thing to establish, because it decides whether a project is possible before planning is even discussed. There are three positions, and only one of them is straightforward.

Private Garden, Freehold House

The garden is yours outright. You need planning permission and nothing else, and the project runs like any other bespoke build. This is the minority of W9 property but it is where most garden rooms here get built.

Garden Demised to Your Flat

Your lease grants you exclusive use of part of the garden, often a ground floor flat with the rear section. A build may well be possible, but you need freeholder consent under the lease as well as planning permission, and the lease may restrict structures outright. Read the demise plan before spending anything.

Communal Garden

The garden belongs to the block and is managed by the owners' association or the freeholder. No individual leaseholder can build on it unilaterally, whatever the planning position. Freeholder Consent Is Not Planning

Leaseholders regularly assume that planning permission settles the matter. It does not. Consent under the lease is a private contractual process between you and the freeholder, with its own timescale and its own fees, and the council has no part in it. Both have to be in place, and it is worth starting the consent conversation early because it is usually the slower of the two.

Two things get stated as fact about Maida Vale that are not accurate. There is no Little Venice Conservation Area, Little Venice sits inside the Maida Vale Conservation Area. And there is no Article 4 Direction removing outbuilding rights across Maida Vale. Westminster publishes its directions, and the only one in W9 covers Bristol Gardens, a small separate conservation area.

Conservation area status by itself does not remove permitted development rights for a building in a rear garden either. It restricts buildings at the side of the property.

Full planning permission is still the norm here, and in Maida Vale the reason is usually the housing stock rather than the designation.

  • Flats Have No Rights at All

    The GPDO defines a dwellinghouse as one that does not include a building containing flats, or a flat within such a building. Part 1 permitted development simply does not apply. In an area this heavily flatted, it is the reason in most cases.

  • Listed Buildings and Curtilage

    Nothing is permitted development within the curtilage of a listed building. Numbers 84 to 118 Maida Vale are listed, and St Mary Magdalene, the Catholic Apostolic Church and Maida Vale Underground station are all listed in their own right.

  • Height Near a Boundary

    The 2.5m cap applies wherever any part of the building is within 2m of a boundary. On a walled W9 plot that is most of the garden.

Craned Delivery and Westminster Licensing

Wide tree-lined avenues do not mean easy access. The plots sit behind terraces and mansion blocks with no rear vehicle route, so the build comes in over the roof or through the building. What makes Maida Vale different from most of London is how much of the lift day is a council process, and each of these has a lead time that belongs in the programme rather than in a surprise invoice.

Crane Oversail Permit

Required where a crane jib passes over the public highway. Westminster issues these for periods of up to six months.

Any hoarding on the highway needs one, close-boarded to at least 2.44 metres.

Mature planting along the canal corridor and through the rear gardens brings root protection into the foundation design, and no mini-digger reaches these plots in any case. Westminster requires six weeks' written notice before any work to a tree in a conservation area, whether or not it carries a preservation order, so tree work has to be identified at survey rather than discovered mid-build.

The difference is craned delivery and the licensing that goes with it, hand-dug foundations, a full Westminster application, and on leasehold property the additional freeholder consent stage. W9 sold prices averaged £854,787 over the last twelve months, down about ten per cent year on year and sixteen per cent below the 2023 peak, according to Rightmove data accessed on 20 July 2026. Maida Vale and Warwick Avenue are both on the Bakerloo line in Zone 2, with Little Venice, Rembrandt Gardens and the 27 acres of Paddington Recreation Ground within walking distance, and Clifton Nurseries on Clifton Villas trading on the same site since an 1851 lease.
